A woman has filed a lawsuit against the Cleveland Police Department, claiming several officers mistakenly raided her home during a homicide investigation of a 12-year-old boy who was killed in a drive-by shooting.
The lawsuit states that Cleveland detective David Borden obtained a search warrant for the address of Larissa Harris, who is one of the individuals charged with the Nov. 24 2017 killing of Abdel Bashiti. He was shot by a stray bullet when he walked out of his dad’s beauty supply store at East 116th Street and Buckeye Road. However, police raided Paula Mitchell’s house across the street instead, who told them they had the wrong home.
Police spent over an hour questioning Mitchell and her family members about the shooting, searched the home and caused almost $9,000 in damage to the property.
“The police were not commanded to destroy the interior of the residence but they nevertheless did so of their own free will, maliciously, and with wanton and reckless abandon,” court documents said.
Borden received a written reprimand for his actions.
The lawsuit seeks $25,000 in compensatory damages in addition to punitive damages for causing Mitchell “permanent physical and emotional harm including but not limited to post-traumatic stress disorder.”
