Melissa Weber, whose 11-year-old daughter was attacked by a drunk teen wearing Mickey Mouse ears at Epcot, has finally settled her lawsuit with Disney.
The lawsuit stemmed from an incident on Jan. 13, 2017. A 17-year-old Naples girl grabbed the child by the hair, tossed her into a garbage can and then starting punching her when she was on the ground. She was also accused of attacking another person at the park and was charged with child abuse, battery and criminal mischief.
The 17-year-old was with her boyfriend and a friend, who all appeared to be drunk, according to a police report. Her friend “dropped her cell phone to the ground and attempted to pick it up but fell to the ground to her knees due to being intoxicated,” close to the Epcot sphere.
Colette Santana was going toward the exit of the park with her friends and told them to walk around the teenager who was on the ground. The teenager was upset that they didn’t offer to help her and swore at them. Then, she ran up to Santana and hit her ear with a closed fist.
After several people came by and broke up the attack, Santana and her friends went to the bathroom for a few minutes. When they came back out, there was a huge crowd. That’s when the 11-year-old child was attacked.
Weber said that her 11-year-old daugher suffered severe injuries from the attack. She said that her child has gone through “anxiety, fear, depression, and post-traumatic stress disorder.”
Weber filed the lawsuit against Disney in 2018, alleging that they served alcohol to someone underage and failed to keep the guests safe. While she has sought more than $15,000 in damages at the time of the filing, court documents don’t reveal the final amount of the settlement.
