DC Legal Requirements for Brain Injury Claims

Washington, D.C. has several legal rules that shape the outcome of every brain injury case. A working understanding of these provisions matters because a missed deadline or a misapplied fault standard can bar recovery entirely.

Statute of limitations. Under D.C. Code § 12-301, most personal injury claims must be filed within three years from the date of the injury. Claims against the District government are subject to a stricter notice requirement, and a written notice of claim must be delivered within six months as set forth in D.C. Code § 12-309. Brain injury symptoms do not always present immediately after an accident, so early consultation with counsel is advisable.

Contributory negligence. The District of Columbia applies a pure contributory negligence rule. Under this standard, a plaintiff who is found to be even one percent at fault for the accident may be barred from recovering from other responsible parties. Only a small number of jurisdictions in the country still follow this rule, and it is the principal reason insurance adjusters work aggressively to assign partial blame to injured claimants. What Damages Are Recoverable in a DC Brain Injury Case?

Economic damages. These represent the measurable financial losses caused by the injury. Recoverable economic damages commonly include past and future medical expenses, rehabilitation costs, lost wages, diminished earning capacity, and the cost of long-term attendant care. Brain injuries frequently require neuropsychological testing, cognitive rehabilitation, occupational therapy, and in many cases lifelong supportive care. The CDC data on traumatic brain injury documents the substantial number of deaths and long-term disabilities attributable to TBI each year in the United States, and the NIH brain injury resources describe typical medical and rehabilitative costs associated with recovery.

Non-economic damages. These compensate victims for losses that do not have a fixed dollar value, including pain and suffering, emotional distress, loss of enjoyment of life, and loss of consortium for a spouse. Punitive damages are not available in every matter and require clear and convincing evidence of malice or reckless indifference.

Recoverable damages can include loss of financial support, loss of companionship, and funeral and burial expenses.
