Two families have filed a class-action lawsuit against Fisher-Price just two week after the company recalled the Rock ‘N Play sleepers.
The toy company recalled millions of the Rock ‘N Play sleepers in the beginning of this month after it was revealed that these sleepers had been connected to over 30 infant deaths and over 100 injuries since the product launched 10 years ago.
Samantha Drover-Mundy and Zachary Mundy of Delaware filed the first lawsuit, claiming that the recall didn’t come soon enough to save their 12-week-old infant daughter, who died moments after being put in a Rock N’ Play sleeper last September.
“This recall was too late to save the lives of more than 30 infants and to prevent the injuries of numerous other infants caused by the Rock ‘n Play,” the lawsuit states. “The Rock ‘n Play causes death or injury to infants because its defective design enables them to move into positions in which they cannot breathe.”
Cassandra Mulvey, of Nassau County, New York filed a second lawsuit against the toymaker, saying she received the item as a gift in 2016 to “use as a sleeper for overnight or prolonged sleep for her infant.”
The Drover-Mundy lawsuit claims that Fisher-Price and Mattel ignored safety standards when designing the product and kept marketing it as a safe sleep device even though there were numerous reports of injuries and deaths of infants.
Both of the families are seeking unspecified damages in the lawsuit and want to create two classes of potential claimants: one for New York and the other nationwide.
